Terms of Service

The agreement between you and Cardamom.

Effective May 1, 2026

These terms govern use of the Cardamom service by restaurants and their authorized users (“Customer,” “you”). By signing an order form or using the service, you agree to these terms.


The service

Cardamom is an AI phone-ordering platform for restaurants. We provide an AI voice agent that answers inbound calls to a phone number we assign or accept, takes orders, and forwards them to the Customer's POS, kitchen, or designated email. We provide a web dashboard for managing menus, viewing orders, and monitoring call activity.


Pricing and payment

Cardamom is billed at $299 per location per month, paid in advance, unless a different rate is specified in a signed order form. Multi-location pricing and pilot pricing may be agreed in writing.

Subscriptions auto-renew monthly until canceled. You may cancel at any time with 30 days' written notice; service continues through the end of the paid period. Refunds are not provided for partial months except where required by law.

Telephony minutes, SMS, and POS-integration fees billed by upstream providers are passed through at cost; we will provide a separate line item for any pass-through fees.


Term and termination

Either party may terminate for material breach by the other party that is not cured within 30 days of written notice. We may suspend the service immediately if your use threatens the security or operation of the platform or violates applicable law.

On termination we will provide an export of your menu, order, and call-log data within 14 days. We will delete your data from our active systems within 30 days of termination, except as required to comply with law or to retain in encrypted backups (30-day rotation).


Service level

We target 99.9% monthly uptime for the voice service. If we fall below 99.5% in a calendar month, we will credit your next invoice 5% of the monthly fee for that location. If we fall below 99.0% we will credit 10%. Credits are your sole remedy for downtime.

Excluded from uptime calculations: scheduled maintenance with 48 hours' notice, force majeure, and outages caused by upstream providers (Supabase, Vercel, LiveKit, OpenAI, Cartesia, Twilio).


Acceptable use

You will not use the service to: (a) process orders for goods you are not authorized to sell, (b) collect or process information in violation of law, (c) reverse-engineer or attempt to extract our models, (d) resell the service without our written agreement, or (e) circumvent usage limits.


Data ownership

You own your menu, your orders, your customer data, and your call recordings (“Customer Data”). We own the platform, our models, our system prompts, and any aggregated, de-identified analytics derived from operating the service. We will not use Customer Data to train models that serve other customers without your explicit written consent.


Confidentiality

Each party will protect the other's non-public information with the same care it uses for its own confidential information, and at minimum reasonable care.


Warranty disclaimer

The service is provided “as is.” Cardamom's AI agent will sometimes make mistakes — misunderstand an order, mishear a modifier, or fail to recognize an allergy. We provide tooling to flag and correct errors and we work with you to improve accuracy, but we do not warrant that the service will be error-free. We disclaim all implied warranties to the maximum extent permitted by law.


Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, consequential, special, or incidental damages. Each party's total liability arising out of or related to these terms is capped at the fees paid by Customer to Cardamom in the 12 months preceding the event giving rise to liability. This cap does not apply to either party's indemnification obligations or breaches of confidentiality.


Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Wilmington, Delaware.
